TERMS OF USE

Seller Keita Megija Sproģe, brand ''MUUS'' adress: Suknu stacijas street 4, Baltezers, Latvia (further in text - Seller) that is responsible for the website muus.lv (further in text - website), provides goods, services and information under the following conditions.

Seller provides the service in accordance to the ordering, delivery and return policy that is available for you to read in this page. When using this website you agree that you have read the Terms of Use and you agree with them. We have the right to change the Terms of Use without warning.

1. DISTANCE CONTRACT

If the buyer purchases the goods offered in the store via the Internet, such mutual agreement is considered a distance contract and is subject to rules governing distance contracts, included but not limited to, Directive 97/7 EC of the European Parliament and of the Council on consumer protection in connection with distance contracts, teh Law of the Republic of Latvia ''Law on the Protection of the Consumer Rights'', regulations of the Cabinet of Ministers of the Republic of Latvia ''Regulations on distance contracts''.

The seller of the goods offered in this online store www.muus.lv from one side, further in text as Seller, and the person placing the order, further in text as Buyer, from the other side, concludes the following Agreement:

2. ORDERING, PAYMENT AND DELIVERY PROCEDURES

We take the responsibility to sell and deliver goods according to you order.

  • The buyer orders the goods on this website, indicating the type and quantity of the goods.
  • The buyer has the oppurtunity to pay for the products using Swedbank, SEB, Citadele, Luminor, Revolut or N26 internet bank, card, Apple pay / Google pay or Inbank 3 interest free payments, or in some cases by paying the invoice prepared by the seller and sent by e-mail. For other countries payment methods can differ. The invoice is prepared electronically and is valid without a signature.
  • The contract is confirmed at the time of successful payment to the bank account of the online store. If for some reason it will not be possible to fulfill the order, the Buyer will be informed about it and the amount paid will be refunded as soon as possible, but no later than within 14 days after receiving the notification.
  • All items on the website are indicated in EUROS  ( € ) with all taxes included. Delivery cost is not included in the price of the product.
  • The seller delivers the goods to the adress specified by the buyer in accordance with the tarrifs set by the courier. The buyer pays the shipping cost and the product cost before receiving the confirmation and before the delivery of the goods. The delivery price is included in the invoice, which is sent to the email adress provided by the buyer. By placing an order on the website, the Customer also agrees  to the terms of use of the chosen courier service and payment platform.

The Buyer or a person representing the Buyer must verify the conformity of the goods at the time of delivery or no later than within 14 days from the moment of delivery of the goods.

3. COMMUNICATION WITH CLIENT

  • For communication with the Buyer Seller used the e-mail address specified in the customer's order.
  • For communication with the Seller, the Buyer uses the e-mail address [email protected], social network or the contact form on the website.
  • In exceptional cases, the Seller contacts the Buyer using the phone number specified in the order.
  • The buyer must ensure that the contact information provided in the order is correct.
  • The messages sent by the Buyer are processed at the first opportunity, but no later than within 2 working days.

4. THE RIGHT OF RETURN

You have the right to return the product within 14 days after receiving the product.

How to return the product:

  • Fill this return form ATGRIESANAS_VEIDLAPA and add it to the return package;
  • Return the product to the seller (return shipping cost is covered by the customer);

Return takes about 5 business days. When package is received in warehouse, client receives email. We take responsibility within 14 days after receiving and checking the returned package (excluding weekends and public holidays) to return the money.

The buyer pays for the returning of the product, except when the reason for the return is that the product does not correspond to the order (for example, wrong or damaged product).

The customer won't receive money for delivery or bank commission that may be applied to customer's money transfer by individual banks.

You can not use the right of return if:

  • the product is used or damaged ( excluding damage caused by delivery)
  • the product is made for client by an individual order;
  • If the goods were purchased by a legal entity.
Section 12, Paragraph six of the Consumer Rights Protection Law of the Republic of Latvia stipulates that ''the Consumer is responsible for maintaining the quality and safety of the product during the period of withdrawal''. The Seller reserves the right to refuse the Buyer the right of withdrawal or withold the compensation in case of damage to the product, negligent handling of the product during use or non compliance with the instructions, or if the original packaging is lost or significantly damaged.


The buyer is obligated to keep the courier delivery and payment documents and product return documents.

5. CLAIMS AND PRODUCT DEFECTS

If the Customer during use has found that the quality of the product does not meet the Customer's requirements, the Customer has the right to submit a claim within 2 years. The Customer must send the product together with the claim to the Seller to the following address: Ādaži, TC Apelsīns, Omniva parcel machine, Rīgas gatve 5, LV2164. When returning the product to the Seller, the Customer pays for the shipping costs. The product is checked within 14 days from the moment it is received in the warehouse. The client receives the answer to the e-mail address specified in the claim form. If during the inspection of the product, it is found to be a manufacturing defect, all costs related to the purchase of the product (delivery, return costs and the value of the product) will be refunded to the customer within 14 days from the moment of the decision, the bank commission fee will not be refunded, as it is not directly related with the provision of the Seller's service, we can also agree on the exchange of the product.

The Customer cannot file a claim in cases if:

  • The defect occurred as a result of improper use, not taking into account the Seller's recommendations;
  • The defect occurred when the Buyer carelessly opened the package or moved the product in an inappropriate manner;
  • The product is completely used, lost or otherwise unavailable and the Seller cannot physically check it.

6. DATA PROCESSING

Entering the necessary information when placing an order, you agree that you have read the terms of use and you agree that your personal data will be used to process and deliver the order in accordance with the requirements of the law. When entering the personal information, you agree to receive an e-mail about your order.

7. CUSTOMER OBLIGATIONS

While visiting and using this website you agree:

  • To learn about the distance contract;
  • To learn about our: PRIVACY POLICY;
  • To treat other website users and our company with respect  using appropriate language, for example in the comment section;
  • To not spread false, misleading and unverified information that could cause harm to our business;
  • To not intentionally cause harm to our business by misusing the available information;
  • To not use another person's data while making the purchase or other activities on this website;
  • Provide true information about yourself while making the purchase or other activities on this website.

8. DISPUTE RESOLUTION PROCEDURE

In matters that are not discussed in these terms and conditions, the Buyer and the Seller undertake to comply with the laws and regulations in force in the Republic of Latvia.

The parties resolve all disputes between the Seller and the Buyer through mutual negotiations or correspondence. If the dispute cannot be resolved through negotiations or correspondence, the Parties will resolve the dispute in the court of the Republic of Latvia, observing the laws and regulations of the Republic of Latvia. 

Disputes between the Buyer (consumer) and the Seller can be referred to the Consumer Rights Protection Center or the court of the Republic of Latvia for resolution.

The buyer also has the right to appeal to the European Union dispute settlement institutions.
